§ 1 scope

(1) The following general terms and conditions apply to all business relationships between mineralien.de (Christian Weise Verlag GmbH) and its customers. (2) Our general terms and conditions apply exclusively. We do not recognize any conditions of the customer that contradict or deviate from our general terms and conditions; unless we have expressly agreed to their validity in writing. Our general terms and conditions also apply if we carry out the delivery to the customer without reservation in the knowledge of conflicting or deviating terms and conditions of the customer.

§ 2 Registration

(1) Every order of goods requires prior registration as a customer at mineralien.de (Christian Weise Verlag GmbH). Multiple registrations under different names or addresses are not permitted. After successfully completing the registration process, the mineralien.de customer is admitted to the system. (2) The admission can be revoked by mineralien.de (Christian Weise Verlag GmbH) at any time and without giving reasons. In this case, Christian Weise Verlag GmbH is entitled to block the user name and the corresponding password immediately.

§ 3 Conclusion of the contract, order fee

(1) The presentation of the range of mineralien.de (Christian Weise Verlag GmbH) on computers that can be accessed via the Internet does not constitute an offer within the meaning of §§ 145 ff. BGB. (2) By placing an order by e-mail mineralien.de (Christian Weise Verlag GmbH), he submits an offer within the meaning of § 145 BGB. The customer receives a confirmation of receipt of the order by email. Until the offer is accepted by mineralien.de (Christian Weise Verlag GmbH), the customer can revoke the offer at any time. (4) For larger orders, mineralien.de (Christian Weise Verlag GmbH) reserves the right to request a deposit. The order will be processed after mineralien.de (Christian Weise Verlag GmbH) has received the deposit.

§ 4 delivery, shipping costs

(1) mineralien.de (Christian Weise Verlag GmbH) delivers the ordered goods immediately to the address given by the customer in the order. mineralien.de (Christian Weise Verlag GmbH) is entitled to make partial deliveries. (2) Information about the expected delivery times is non-binding, unless mineralien.de (Christian Weise Verlag GmbH) has given the customer a binding commitment in writing in individual cases. (3) Delivery takes place at the shipping costs shown in each individual case. All risks and dangers of the shipment - if the customer is an entrepreneur and when concluding the legal transaction is exercising his commercial or independent professional activity - to the customer as soon as the goods from mineralien.de (Christian Weise Verlag GmbH) to the commissioned logistics partner is passed. If the customer is a consumer, all dangers and risks of the loss of the item are only transferred to the customer when the item is handed over to the customer.

§ 5 retention of title

(1) Until the purchase price has been paid in full, mineralien.de (Christian Weise Verlag GmbH) retains ownership of the goods supplied. (2) In the case of goods that the customer purchases from mineralien.de (Christian Weise Verlag GmbH) in the course of his commercial activity, property remains reserved until all claims by mineralien.de (Christian Weise Verlag GmbH) against the customer from the business relationship including future claims arising from contracts concluded at the same time or later have been settled.

§ 6 Due Date and Payment

(1) All prices include 19% VAT. The final prices result from the prices plus shipping costs.

(2) The respective shipping costs are itemized under delivery and shipping costs and are also shown during the ordering process. The contract is only concluded with the invoice sent by mineralien.de (Christian Weise Verlag GmbH). The confirmation sent by the system is only to be understood as an acknowledgment of receipt. The bill has to be paid immediately.

§ 7 revocation

You can revoke your contract declaration within 1 month without giving reasons in text form (e.g. letter, fax, e-mail) or - if the item is given to you before the deadline expires - by returning the item. The period begins after receipt of this instruction in text form, but not before receipt of the goods by the recipient (in the case of recurring delivery of similar goods, not before receipt of the first partial delivery) and also not before the fulfillment of our information obligations in accordance with Article 246 § 2 in conjunction with § 1 Para 1 and 2 EGBGB as well as our obligations according to § 312e Paragraph 1 Clause 1 BGB in connection with Article 246 § 3 EGBGB. The timely dispatch of the cancellation or the item is sufficient to meet the cancellation deadline.

Consequences of cancellation

In the case of an effective cancellation, the mutually received services are to be returned and any benefits (e.g. interest) surrendered. If you cannot return the received service in whole or in part, or if you can only return it in a deteriorated condition, you may have to compensate us for the value. This does not apply to the surrender of items if the deterioration of the item is solely due to its inspection - as it would have been possible for you in a shop, for example. You do not have to pay compensation for a deterioration caused by the intended use of the item.

Transportable items are to be returned at our risk. You have to bear the costs of returning the goods if the goods delivered correspond to the goods ordered and if the price of the goods to be returned does not exceed an amount of 40 euros or if you have not yet received the consideration or contractually at a higher price for the goods at the time of cancellation have made the agreed partial payment. 4 Otherwise, the return is free of charge for you. (1) Insofar as the customer is an entrepreneur, the assertion of warranty rights requires that he has properly complied with his inspection and complaint obligations in accordance with Section 377 of the German Commercial Code (HGB). If the customer is an entrepreneur, the limitation period is 12 months, calculated from the time of transfer of risk; the limitation period in the case of delivery recourse according to §§ 478,479 BGB remains unaffected. It is five years from delivery of the defective item.

§ 9 data protection

(1) Storage and processing of personal data: mineralien.de (Christian Weise GmbH) undertakes to protect the privacy of all persons who shop via the mineralien.de (Christian Weise Verlag GmbH) website and to keep the personal data of customers confidential to treat. This is based on the applicable statutory provisions. The data received from customers are saved. However, customers can have their data deleted at any time. (5) Security measures to avoid the loss and misuse of personal data: When transmitting personal information / data, mineralien.de (Christian Weise Verlag GmbH) uses encryption technology to ensure maximum confidentiality. The personal data of the customers are password-protected so that only the respective customers have access to it. The servers of mineralien.de (Christian Weise Verlag GmbH) use various security mechanisms and authorization procedures to make unauthorized access to customer data more difficult.

§ 10 Fixed book prices / VAT: Books are subject to fixed book prices. The prices set by the publishers apply. All book prices include 7% VAT. If this is changed, the prices will also change! All other prices include 19% VAT.

§ 11 final provisions

(1) The contract between mineralien.de (Christian Weise Verlag GmbH) and the customer is exclusively subject to the substantive law of the Federal Republic of Germany; the application of UN sales law is excluded. (2) As far as the customer is a businessman, Munich is the exclusive place of jurisdiction for all claims from and in connection with the business relationship between mineralien.de (Christian Weise Verlag GmbH) and the customer. The same place of jurisdiction applies if the customer does not have a general place of jurisdiction in Germany, has moved his domicile or usual place of residence outside of Germany after the conclusion of the contract, or if the place of residence or usual place of residence of the customer is not known at the time the action is brought.

 

THE FOLLOWING GENERAL TERMS AND CONDITIONS ONLY APPLY TO ENTREPRENEURS IN THE MEANING OF Section 310 (1) BGB:

§ 1 scope

For the business relationship between mineralien.de (Christian Weise Verlag GmbH) and the customer - also for all future business - the following general terms and conditions apply exclusively in the version valid at the time of the order. Mineralien.de (Christian Weise Verlag GmbH) does not recognize any deviating conditions of the customer unless mineralien.de (Christian Weise Verlag GmbH) has expressly agreed to their validity in writing.

§ 2 Conclusion of the contract and withdrawal

mineralien.de (Christian Weise Verlag GmbH) undertakes to accept the order of the customer under the conditions of the website. In the event of spelling, printing or calculation errors on the website, mineralien.de (Christian Weise Verlag GmbH) is entitled to withdraw from the contract.

§ 3 delivery

Unless otherwise agreed, delivery will be made from the warehouse to the delivery address specified by the customer. The risk passes to the purchaser as soon as the delivery has left mineralien.de (Christian Weise Verlag GmbH), even if partial deliveries are made. Information about the delivery period is non-binding, unless the delivery date has been promised as an exception.

§ 4 Due Date, Payment and Default

The purchase price is due immediately upon ordering. The customer can pay the purchase price by credit card, check or direct debit. If the customer is in default of payment, mineralien.de (Christian Weise Verlag GmbH) is entitled to demand default interest of 4% above the base rate announced by the Deutsche Bundesbank. If mineralien.de (Christian Weise Verlag GmbH) demonstrably incurred higher damage caused by delay, he is entitled to assert this.

§ 5 Offsetting, retention

The customer is only entitled to offset if his counterclaims have been legally established or have been recognized by mineralien.de (Christian Weise Verlag GmbH). In addition, he is only authorized to exercise a right of retention if his counterclaim is based on the same contractual relationship.

§ 6 retention of title

The delivered goods remain the property of mineralien.de (Christian Weise Verlag GmbH) until all claims against the customer have been settled in full.

§ 7 Warranty for Defects and Liability

If there is a defect in the purchased item for which mineralien.de (Christian Weise Verlag GmbH) is responsible, mineralien.de (Christian Weise Verlag GmbH) is entitled, at its own discretion, to either remedy the defect or make a replacement delivery. If mineralien.de (Christian Weise Verlag GmbH) is not willing or able to remedy the defect / replacement delivery, or if this is delayed beyond a reasonable period for reasons for which mineralien.de (Christian Weise Verlag GmbH) is responsible, or otherwise If the rectification of defects / replacement delivery fails, the customer is entitled, at his option, to withdraw from the contract or to demand a corresponding reduction in the purchase price. The above limitation of liability does not apply if the cause of the damage is based on intent or gross negligence. Furthermore, it does not apply if the customer asserts claims from §§ 1, 4 of the Product Liability Act, claims due to the lack of a warranted property or claims for damages due to non-performance in accordance with §§ 463, 480 Paragraph 2 BGB. The same applies to initial inability or impossibility for which we are responsible. If mineralien.de (Christian Weise Verlag GmbH) negligently breaches an essential contractual obligation, the obligation to pay compensation for damage to property or personal injury is limited to the damage that typically occurs. The warranty period is twelve months from the transfer of risk. This period is a statute of limitations and also applies to claims for compensation for consequential damage caused by defects, provided that no claims are asserted from tortious acts.

§ 8 data protection

The customer has been informed in detail about the type, scope, place and purpose of the collection, processing and use of the personal data required for the execution of orders by mineralien.de (Christian Weise Verlag GmbH) (see data protection). The customer expressly consents to this collection, processing and use of personal data.

§ 9 Applicable law and place of jurisdiction

German law applies to the exclusion of the UN purchase law. The exclusive place of jurisdiction for all claims in connection with the business relationship is Munich. mineralien.de (Christian Weise Verlag GmbH) is also entitled to sue at the general place of jurisdiction of the customer.
